What happens when I die without a Will?


Al and Barb thought they didn't need wills. They were in their early 50's and in good health, and held all their possessions in joint tenancy so when one died, the survivor would get everything.

But they died in a common accident. Al living for two days in a coma after the car crash that killed Barb.

Al and Barb had no children and so Al's widowed mother, who lived in their basement suite and suffered from Alzheimer's disease inherited everything.

Perhaps this is exactly what Al and Barb would have wanted, but the odds are it wasn't.

Sample Schedule of Distribution Under B.C. Estate Administration Act (Check your province or state for their schedule of distribution)

If You Die and Leave: The Distribution of Your Estate Will Be:
Spouse and no children Entire estate to spouse
Spouse and one child or
children of deceased child.
To Spouse First $65,000. " household furnishings", and "estate for life" in " matrimonial home".
Residue:One-half to spouse, One-half to children per stripes.
Spouse and more than one child (children of a deceased child counted as one living child. To Spouse First $65,000. " household furnishings", and "estate for life" in " matrimonial home".
Residue:One-third to spouse, Two-thirds to children per stripes.
Children (no spouse) To children, per stripes
Father and/or mother Equality to parents, or surviving parent.
Brothers and Sisters Equality to brothers and sisters, if a brother or sister has died leaving a child or children, such child or children take his, her or their parents 'share by representation.
Nephews and Nieces only Equality, with no representation by the children of any deceased nephew or nieces.
Other next of kin Equality among next of kin of equal degree of consanguinty, no representation admitted.
Kindred of half blood Inherit equality with kindred of whole blood.
